07/05/2023 on the Official Internet Portal of Legal Information posted 🏛 Resolution of the Government of the Russian Federation dated 06/28/2023 No. 1060 «On Amendments to Certain Acts of the Government of the Russian Federation» (hereinafter referred to as the Resolution).
The Decree is aimed at bringing Decree of the Government of the Russian Federation No. 1113 dated August 28, 2019 into line with the requirements of the Federal Law “On Fishing and the Conservation of Aquatic Biological Resources”, taking into account the changes that entered into force on January 9, 2023.
🦀 The Decree contains a number of changes to the procedure for holding “crab” auctions, including:
🔹mandatory registration of bidders in the GIS bidding🔹reduction of the period for placing a notice from 30 to 15 days before the day of the auction🔹payment by the bidder of a deposit to a special account of the bidder instead of the account of the operator of the electronic site 🔹mandatory posting of information on the conclusion of contracts following the results of the auction in GIS Trades

📃Changes have been made to the procedure for concluding concession agreements and agreements on public-private partnership (municipal-private partnership)📃
The Official Internet Portal of Legal Information posted 🏛 Federal Law of July 10, 2023 No. 296-FZ “On Amendments to Certain Legislative Acts of the Russian Federation” (hereinafter referred to as the Federal Law).
📍Federal law from 03/01/2024 establishes the possibility of holding an open tender for the right to conclude a concession agreement and an agreement on PPP (MPP) in electronic form. And from 01/01/2026, holding such contests in electronic form will become mandatory.
When conducting electronic competitions, messages about their conduct will be posted in the GIS TORGI and, through information interaction, automatically published on electronic platforms accredited in accordance with Federal Law No. 44-FZ of 05.04.2013.
ℹ️ Also, from 01.10.2023, separate changes are being made to the procedure for posting information on holding open tenders for the right to conclude concession agreements and PPP (MPP) agreements in paper form in the GIS TORGI.

On July 20, Deputy Head of the Federal Treasury Anna Katamadze took part in a round table meeting of the Federation Council Committee on Budget and Financial Markets.
The round table was devoted to the issues of improving the legislation regulating procurement activities in order to restructure the economy.
In her report, Anna Katamadze outlined further steps in the digitalization of procurement: “Of course, we will follow the path of digitizing both acceptance and contracting – not only traditional contracts, but all utility contracts.”
🆕 Amendments have been made to the Federal Law “On Fishing and the Conservation of Aquatic Biological Resources” 🆕
Effective September 1, 2024, Federal Law No. 384-FZ dated July 24, 2023 “On Amendments to the Federal Law “On Fishing and Conservation of Aquatic Biological Resources” (hereinafter referred to as the Federal Law) establishes the holding of tenders for the sale of the right to conclude contracts in areas of fishing in the form of electronic auctions.💡 In addition, at the initiative of the FEDERAL TREASURY, the norms have been fixed, according to which the GIS TORGI will become mandatory:

The federal law establishes that residential premises confiscated from persons who have committed corruption offenses will be sold at auctions, information about which is posted in the GIS TORGI.
At the same time, the changes will affect luxury housing, the cost of which exceeds the average cost of housing in the corresponding region.

Changes were made to the procedure for privatization of cultural heritage objects
Federal Law No. 370-FZ dated July 24, 2023 “On Amendments to Certain Legislative Acts of the Russian Federation” (hereinafter referred to as the Federal Law).
Main changes: 🔹 objects of cultural heritage (CHO) in a satisfactory condition will be sold at an auction, and in an unsatisfactory condition — at a competition 🔹 the land plot occupied by an object of cultural heritage will be leased to the winner for 1 ruble per year until the conditions of the competition are met 🔹 SMEs renting cultural heritage objects have the pre-emptive right to acquire them, regardless of the methods of privatization
👉 The federal law comes into force on 08/03/2023.
Gas distribution and gas consumption networks, as well as objects of such networks can be privatized
Federal Law No. 345-FZ of July 24, 2023 “On Amendments to the Federal Law “On the Privatization of State and Municipal Property” (hereinafter referred to as the Federal Law).
The federal law establishes the conditions for the privatization of gas distribution and gas consumption networks, information on the sale of which is placed in the GIS TORGI.
These conditions of sale include:
🔸 encumbrance with operational obligations, such as reconstruction, development and security of gas supply facilities 🔸 principle of integrity and unity of gas supply facilities
At the same time, the pre-emptive right to purchase such facilities is granted to gas distribution organizations that continuously operate it for at least two years.

Extended transition to mandatory use of MCHD
Federal Law No. 457-FZ dated August 4, 2023 “On Amendments to Certain Legislative Acts of the Russian Federation” (hereinafter referred to as the Federal Law).
The Federal Law extended the possibility of using qualified certificates of employees of legal entities without providing a power of attorney in electronic form in machine-readable form (hereinafter — MCHD) until 08/31/2024.
At the same time, accredited certification centers are not entitled to issue the specified qualified certificates for employees from 09/01/2023.
In this regard, we recommend extending the validity period (ensuring reissuance) of certificates of a qualified electronic signature of legal entities issued to employees of organizations until 09/01/2023.
From 10/01/2023, the formation of MCHD will be available in the GIS TORGI for work in the system, as well as on electronic platforms.
At the same time, until 09/01/2024, taking into account the provisions of the Federal Law, the TORGI GIS will also support the possibility of signing documents without the attachment of MCHD, if such signing is carried out by a qualified electronic signature of a legal entity.
👉🏼 The federal law came into force on 08/04/2023, with the exception of certain provisions.
📃 The procedure for securing and providing shares of quotas for the extraction (catch) of aquatic biological resources for investment purposes was approved 📃

Decree of the Government of the Russian Federation of 07.08.2023 No. 1286 “On fixing and providing shares of quotas for the production (catch) of aquatic biological resources, provided for in paragraphs 11 and 13 of part 1 of Article 30 of the Federal Law “On Fishing and Conservation of Aquatic Biological Resources” (hereinafter — Decree).
The Decree establishes that from 01.01.2024 in the GIS TRADINGS are subject to placement: ✔️ information on the beginning and conditions for the selection of investment projects ✔️ notification of holding an auction for a decrease ✔️ information on the results of the selection and auction
👉 The Decree entered into force on 08.08.2023, with the exception of certain provisions.
